What does a truck accident lawyer cost?

We handle truck accident cases on a contingency fee. There are no upfront costs, no hourly rates, and no charge for the initial consultation. Why are truck accident cases more complicated than car accidents?

Truck cases usually involve more than one defendant, larger insurance policies and a layer of commercial safety rules that does not exist in an ordinary car claim. The evidence that decides them is different too: driver logs, maintenance records, electronic data from the truck itself and dash cam footage are often the whole case, and they sit with the trucking company rather than with you.

Can I sue the trucking company, or only the driver?

Often the company as well. A motor carrier can be responsible for negligent hiring, for training failures, for scheduling that pushed a driver past safe hours, or for maintenance it did not do. Liability depends on the facts, and it can also reach a company that hired the carrier, a maintenance provider, a cargo loader, a parts manufacturer, a broker, or a government entity where road design or a road defect played a part.

This matters for one practical reason: insurance coverage may exist at several levels, and finding every responsible party is often what decides whether a claim can cover a lifetime of care.

What evidence disappears after a truck crash?

The kind that proves the case. Driver logs, hours-of-service records, maintenance and inspection records, electronic control module data, dispatch records and dash cam footage can all be overwritten, discarded or routinely destroyed if nobody demands them in time. Trucking companies and their insurers often have investigators at the scene within hours.

That is why the first call matters more in a truck case than in almost any other. A lawyer can send a preservation demand that makes destroying those records a legal problem for the company.

How long do I have to file after a truck crash in Florida?

Florida sets strict deadlines, and which one applies to you turns on the date of the crash. As the firm's own site puts it: if the crash happened on or before 3/23/2023, you may have four years to file; if it happened after 3/23/2023, you may have two years to file.

Some cases carry different deadlines, particularly claims against a government defendant and other special circumstances. Acting quickly also protects the evidence, including camera footage that can be overwritten within days.

Does my own insurance pay first in Florida?

Florida is a no-fault state for many car accident claims. That means your own Personal Injury Protection (PIP) coverage is typically the first source of payment for medical expenses and certain losses, regardless of who caused the crash.

If your injuries and losses exceed what PIP covers, or your injuries meet certain legal thresholds, you may be able to pursue compensation from the at-fault driver and other responsible parties. PIP generally does not pay for pain and suffering. It often does not cover the full cost of a serious injury or the income you lose.

What if the trucking company says the crash was my fault?

Do not accept it. Trucking insurers routinely blame the other driver, because Florida's fault rules reduce what they pay for every percentage point assigned to you.

Florida uses a modified comparative fault system with a 51 percent bar. You can recover compensation if you are 50 percent or less at fault, and your compensation is reduced by your percentage of fault. If you are 51 percent or more at fault, you cannot recover damages from the other negligent party.

This is why insurers argue that you were partly at fault. Any percentage assigned to you reduces what they pay. At 51 percent they pay nothing.

Should I give the trucking company's insurer a recorded statement?

Not before you have spoken to a lawyer. The adjuster calling you works for the company whose truck hit you. A recorded statement taken in the first days, before anyone knows how badly you are hurt, is used later to argue you were less injured than you say or more at fault than you were. You are not required to give one to the other side's insurer.

Should I accept a quick settlement offer after a truck crash?

Talk to a lawyer first. A quick offer usually arrives before anyone knows whether your injury is permanent, and accepting it normally means signing a release that ends the claim for good, including for treatment you have not had yet. What Florida Law Requires

No lawyer can promise you money. Four things decide whether a Florida truck accident claim recovers anything.

1. Prove negligence

  • Duty. They had to be careful.
  • Breach. They were not.
  • Causation. That is what hurt you.
  • Damages. It cost you real money or real health.
Burden of proof is on you.

2. Insurance rules

  • Your own PIP pays first. Medical expenses and certain losses, regardless of who caused the crash.
  • Serious injuries can go further. If your losses exceed PIP, or your injuries meet certain legal thresholds, you may pursue the at-fault driver.
  • PIP has limits. It often does not cover the full cost of a serious injury, lost income, or pain and suffering.

3. Shared fault

  • 50 percent or less at fault. You can still recover.
  • Your share comes off the top. Compensation is reduced by your percentage of fault.
  • 51 percent or more at fault. You cannot recover damages from the other negligent party.
